Terms of Service

Preliminary Provisions

  1. These Terms of Service concern the booking of services available on the website with a guaranteed fixed price based on the data declared via the website, and making payment for such purchase using payment cards, online transfers or cash.
  2. The owner of the website is Elite Ride Spółka z Ograniczoną Odpowiedzialnością based in Rzeszów.

Definitions

  1. Service – the company providing the service/service, located at www.eliteride.pl.
  2. Terms of Service – this document.
  3. Service Provider – Elite Ride Spółka z Ograniczoną Odpowiedzialnością based in Rzeszów, address: al. Tadeusza Rejtana 53A/108E, 35-326 Rzeszów, NIP: 8133838924, REGON: 386070240.
  4. Service Office – a branch of Elite Ride that carries out the customer service activities provided for in the Terms of Service. Contact with the Service via email: office@eliteride.pl and by phone: +48 535 691 567.
  5. User – means an adult natural person, a legal person and an organisational unit without legal personality, capable of acquiring rights and assuming obligations in their own name, who uses the Service or the service.
  6. Service – means one of the services offered by the Service Provider.
  7. Client – means the User who books vehicle hire.
  8. Consumer – means a natural person performing a legal act with the Service Provider that is not directly related to their business or professional activity.
  9. Service – means one of the services offered by the Service Provider.

Booking a Service

  1. Booking of services is possible depending on availability.
  2. Bookings are accepted and fulfilled by the Customer Service Office.
  3. To book vehicle hire, the Client provides the data specified in the booking form.
  4. Booking requires reading and accepting the Terms of Service and the personal data processing rules (Privacy Policy).
  5. Data provided during the booking of vehicle hire is processed in order to ensure the booking and to prepare a contract at the consumer's request. The legal basis for data processing is the Client's consent. Providing data is voluntary, however providing the data specified in the booking form as required is necessary to make a booking and subsequently conclude a contract (without providing this data it will not be possible to book the service). Data will be processed for the time necessary to ensure the booking or until consent is withdrawn.
  6. For a booking to be valid, it requires confirmation of service availability by the Service Provider. The Service Provider confirms service availability by sending the Client a message via email or by phone.

Payment for a Service

  1. After the Service Provider has confirmed the booking, the Client may pay for the vehicle hire as follows: cash or payment card during the service, or by transfer to the indicated account number.
  2. All information regarding changes, cancellations, new bookings or special requests must be sent to office@eliteride.pl or via the website www.eliteride.pl. If you do not receive a confirmation, please contact us by phone at +48 535 691 567.

Cancellation of a Service

  1. Free-of-charge cancellation of a service may be made 7 days before the scheduled service by the Consumer.
  2. To cancel a service free of charge, the Consumer must send a statement/notice of cancellation to the email address office@eliteride.pl.
  3. The Service Provider shall make the refund using the same payment method used by the Consumer, unless the Consumer expressly agrees to a different refund method that does not incur any costs for them.
  4. The Service Provider shall return all payments made by the Consumer promptly, and no later than 14 days from the date of receipt of the Consumer's withdrawal statement.

Complaints

  1. In the event of problems arising during the provision of the service, please contact the customer service office immediately.
  2. If you decide to notify us of a problematic situation at a later time, please do so no later than 7 days after the completion of the service. After this time, no complaints will be considered.

Personal Data

  1. The administrator of personal data of Clients collected via the Elite Ride website is the Service Provider.
  2. Personal data of Clients collected by the administrator via the Elite Ride website is collected for the purpose of performing the service agreement, and if the Client consents — also for marketing purposes.
  3. The Client has the right to access the content of their data and to correct it.
  4. Providing personal data is voluntary, however failure to provide the personal data indicated in the Terms of Service that is necessary for concluding a service agreement results in the inability to conclude such an agreement.

Final Provisions

  1. Agreements concluded via the Elite Ride website are concluded in Polish.
  2. The Service Provider reserves the right to amend the Terms of Service for important reasons, namely: changes in the law, changes in payment and delivery methods — to the extent that these changes affect the fulfilment of the provisions of these Terms of Service.
  3. In matters not regulated by these Terms of Service, the universally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the provision of electronic services; the Consumer Rights Act; the Act on the protection of personal data.
  4. The Client has the right to use out-of-court methods for resolving complaints and pursuing claims. To do so, they may file a complaint via the EU online dispute resolution platform available at: http://ec.europa.eu/consumers/odr/.
